Overview
This Reseller Policy, which is incorporated in our Terms of Use (“Terms”), applies to all users who are not part of the Ticketmaster Resale Partner Program and who post or sell tickets for resale on our websites and applications (our “Marketplace,” defined in Section 1, below).
When you post or sell tickets for resale through our Marketplace, you agree to be bound by the Terms (which incorporate this Reseller Policy), as they are updated from time to time. You also agree to comply with any terms and conditions set by the people who put on the events—such as artists, venues, teams, fan clubs, promoters, record labels, and leagues (the “Event Organizer”). If you do not agree, don’t post resale tickets for sale or sell tickets through our Marketplace.
NOTICE REGARDING ARBITRATION: Section 14 of the Terms contains an arbitration agreement which may apply to a dispute or claim relating to this Policy, your use of the Marketplace, or products or services sold, distributed, issued, or serviced by us or through us. IT DOES NOT APPLY to claims you may make in small claims court, under provincial consumer protection legislation, or in Quebec or Alberta with respect to claims brought by consumers under the laws of those provinces.
1. Parties
This Reseller Policy, together with our Terms, is a legally binding agreement between you, the user (“you” or “your”), and us. We use the terms “us,” “we,” and “our” to collectively refer to Ticketmaster Canada LP (“Ticketmaster”), Live Nation Entertainment, Inc. (“Live Nation”), Ticketmaster LLC, and all of Ticketmaster and Live Nation’s parents, subsidiaries, general partners, and affiliates. A list of Live Nation’s subsidiaries (which includes, for example, Live Nation Worldwide, Inc. and Ticketmaster, among others) is included in Live Nation’s most recent 10-K report, which is publicly available at https://investors.livenationentertainment.com/sec-filings/annual-reports.
If you are selling a ticket on behalf of a company or other legal entity, you represent and warrant that the company or other legal entity has authorized you to post or sell tickets for resale on their behalf and has agreed to this Reseller Policy (and that references to “you” and “your” also refer and apply to that company or other legal entity).
“Marketplace” refers to our websites and mobile applications—including (without limitation) livenation.ca and ticketmaster.ca—and to our tickets, products, and services.
2. Listing Resale Tickets
You may only list resale tickets that you have the right to sell on our Marketplace. Your ability to resell tickets may be restricted by the Event Organizers or local laws. For example, you may be unable to resell your tickets, subject to maximum resale premiums, restricted with respect to how or where you can resell your tickets (e.g., to our Face Value Exchange), or subject to local licensing rules. We do not provide, and are not responsible for providing, legal advice regarding resale or pricing of tickets. You are solely responsible for how tickets you list are priced, and for complying with all applicable ticket resale laws, including (without limitation) tax laws.
You may not list resale tickets that have been obtained in breach of our Terms or Standard Purchase Policy. You may not list speculative tickets, tickets you don’t already own, or tickets that you don’t have contractual rights to. You can cancel a listing at any time before a ticket is purchased; once a ticket is sold, however, there are no cancellations.
You can accept an order to sell instantly, set the price you’re willing to accept (within parameters established by the Event Organizer) when selling a ticket, and modify the price or delete the listing at any time prior to receiving an offer to purchase the ticket.
You must provide accurate, complete, and up-to-date information for your listings.
We don’t guarantee that resale ticket listings will be published and active within a certain time, or that they will appear in a particular order or in any search results. We also don’t guarantee that listed resale tickets will sell. We are not liable or responsible if any resale tickets are not listed due to a technical or other error, or don’t sell for any reason.
We reserve the right to delist resale ticket listings for any reason.
3. Sale and Fulfilment of Resale Tickets
If a resale ticket you listed on our Marketplace sells, the order will be processed, and you will receive a sale confirmation. Once the sale confirmation is issued:
- You no longer have any rights to the resale ticket and are legally bound to supply the resale ticket to the buyer. We are not a party to any contract between you and the buyer.
- You must select your preferred payment method, supply a valid credit card for refunds, and provide your taxpayer information so that we can pay you for the ticket sale and complete settlement of our transaction with you. We reserve the right to delay payment until you supply the requested information. Once we have all necessary information on file, we’ll typically deposit your payout within 7 business days after the event. Payment receipt times will vary depending on the payment method you choose and are not guaranteed.
- If the buyer’s payment for an order is recalled by the bank or payment provider, we reserve the right to cancel that order and refund the buyer without any further liability. If the resale tickets were transferred to the buyer prior to cancellation, they will be returned to your account.
4. Postponed, Rescheduled, or Moved Events
If the event to which you sold tickets is later postponed, rescheduled, or moved and your original ticket purchase was made through livenation.ca and ticketmaster.ca, your tickets will be returned to your account if: (1) a refund is authorized by the Event Organizer or is required by applicable law, and (2) the buyer has requested a refund. If so, your credit card will be charged to refund the fan who purchased your tickets. If that charge is successful, the tickets will be placed back in your account, and you may have the option to request a refund or credit, keep your tickets for the event, or, if available, repost your tickets for sale. Please note that any refund and/or credit policies are determined on an event-by-event basis by the Event Organizer and may be subject to limitations set by the Event Organizer.
If your original ticket purchase was made through another website, that purchase may be subject to other terms of other marketplaces but is not subject to further refunds from us.
5. Cancelled Events
If the event to which you sold tickets is later cancelled, and you were paid, your credit card on file will be charged to refund the buyer of your tickets. We may offset our refund to you against any payments you owe to us. If your original ticket purchase was made through another website, that purchase may be subject to other terms of other marketplaces but is not subject to further refunds from us.
6. General
We may (but are not obligated to) update any part of this Reseller Policy and our Other Policies from time to time. If we revise this Reseller Policy, we will update the “Effective Date” at the top. The Effective Date above will tell you when this Reseller Policy was last revised, and the Download Prior Version link will take you to the prior version of the Reseller Policy.
By accessing or using the Marketplace, you agree to comply with and be bound by this Reseller Policy and our Other Policies, as applicable, and as they are updated from time to time. Please review them carefully. If you don’t agree, don’t use the Marketplace.
To the extent that this Reseller Policy has been updated from a prior version of the Reseller Policy to which you previously agreed, the most recent version of the Reseller Policy to which you agreed supersedes and governs.
If any part of this Reseller Policy is not valid or enforceable, then that provision shall be deemed severable, meaning it will not affect the validity or enforceability of any remaining provisions.
If you don’t comply with this Reseller Policy, and we don’t act right away, that doesn’t mean we’re giving up any rights now or in the future.
In this Reseller Policy, the section headings are used for reference and convenience only and are not legally binding.
If you see an undefined term in this Reseller Policy, it has the same definition as in the Terms and/or the Standard Purchase Policy and/or the Resale Purchase Policy.
